That depends on your country to a large extent. In some countries all porn is illegal. In some countries gay porn is illegal. But in most of the western world it is perfectly legal for consenting adults to record themselves having sex and share that online.

sites like redtube post a lot of amateur vids that no company has exclusive rights to--but also posts vids of pay sites which a lot of them are just enough to tease you to get you to pay for their sites-- then there are paysites that boycott their films to be allowed on the site--
as for being legal that is what another member posted--it depends on your state and/or country--and it is funny how laws in various states have laws where its against the law to suck a dick orlick a cunt-- so it is based on where you are at
