Hey Guys:

I want to share something that I'm going through with you with the hope that I received some positive, constructive suggestions on how to handle this situation. This is in regard to the building that I live in. I have been in this building for four years now, a quiet tenant who have never been late on the rent. I live in the basement loft which is huge and spacious and I am the only one living down there. I liked it because it kept nosy neighbors out of my business. The first two years, the building was previously owned by a company who took really good care of the maintenance, etc. However, over the last two years, the previous owners had sold the building to new owners who do not keep up the building. Just last year, I was bombarded with mice, the dining room walls are mildewed as well. In December of last year, I got a call from one of the leasing agents reminding me that my lease is coming up for renewal at the end of March 2012. He wanted to know if I am happy with everything and when I revealed to him that I was not and told him why, he asked me what could be done to make sure that I would renew the lease for another year. I asked him if he could take care of the mice problem, paint the living room and dining room walls, and talk to the tenants that live above me about keeping the noise down because they seemed to fight all the time. He agreed. However, nothing was done to take care of what I asked. Suddenly, at the beginning of February, I got another call from an agent because they had sent me a renewal lease to which I was given a two week time space to respond or the lease would renew automatically.

Therefore, in order to give myself enough time to find another place, I signed a six-month month-to-month lease which will take me through the end of September. I received another call where the agent wanted to look at some of their other properties and she had a unit available that she felt I would be interested in. I hesitated at first, and she insisted that I would like it and if so, it was mine. Reluctantly, I scheduled to view the apartment the next morning. Another agent called me earlier that morning to confirm the appointment. However, once I arrived, he wasn't there yet. When he did show up, he immediately informed me that the apartment was no longer available. All of a sudden, a red flag went up because I did not understand why he did not relay this information to me while he was confirming the appointment especially when he told me he found out the night before? From there he went on to tell me about another unit which was located right across the street from where I live. To say the least, I was not interested, and he kept trying to convince me that it is a lot better than the previous one. Again, I gave in and I have to say that once I saw it, I fell in love with it. I told the agent that this was the one that I wanted. To my dismay, this guy started to discourage me with how he would have to run a criminal and background check on me and how he would have to talk to his managers about me first before he gave me an answer.

Feeling very confused, I walked away wanting to get away from him ASAP. He immediately started approaching me about another unit which was on the next street from where I lived. It was raining really heavy and he went on to beg me to see this place. However, he informed me that he would prefer if I was to get my car because he did not feel comfortable with me riding along with him due to the fact that he do not know me and he did not want to be a victim of being beaten up or robbed by me. I could not believe this ass hole was saying this to me. In fact, I humored him to repeat what he just said, and he did with no hesitation. That's when I got upset and reminded him that I did not asked them to look at their properties, they have been calling me because they did not want to lose me as a tenant and for me to be treated with such humiliation as well as being lied to and discouraged about the place I do like when you insisted that I see it, was totally ignorant and stupid on their part and to leave me alone before things get carried to another level which will not be pleasant. Needless to say, I never heard from him again.

A couple of weeks later, the female agent contacted me to inquire about what happened and why the agent did not make me an offer for the place that I liked. When I told her what happened, she apologized and told me that if I still wanted the place, it was mine. However, she wanted me to give her a security deposit to hold the place and keep paying rent on the place that I'm still at and she was given me a two-week time space in order to move into the new place which could not be done on my part especially when I was going to be in the hospital for at least a week for surgery. When I told her this, she told me to contact her when I got out the hospital and if the unit was still available, she will come by my place with the paperwork and to collect the security deposit. Once I got out, I decided to contact her in regard to the availability of the apartment. She told me that it was still available. I told her that due to my health status, I can give her the deposit, but I will not be able to move until the first week of April. This made good sense due to the fact that my lease will expire for the place I'm in now at that time, plus it gives me time to recuperate.

She agreed with my moving until April and asked me if she could come by the next morning with the paperwork so that things can be taken care of and the place will be put on hold until I'm ready to move. Nonetheless, a minute before she was scheduled to come by, she contacted me and informed that the place was put on hold for another potential tenant and that a couple of units will become available within the next month. I immediately got really upset and told her to forget it, and please do not bother me again because I don't appreciate all the game playing, and it doesn't make sense for me to be treated this way especially when I am good paying tenant.

Okay, with all that being said, what do you guys think about this? How would you react to this kind of treatment? Thanks to all whom have taken the time read this as well as responding. I am greatly appreciative of you taking the time to do so. :angry:

I'd look around elsewhere and have nothing more to do with them. They come over to me as a group of complete crooks.

Not dealing with a mice infestation sounds like a probable breach of health & safety laws, but I don't know American law. With them not doing anything about that should send up a signal not to trust them.

Go and find a new leasing agent who will treat you in a fair and decent manner, unlike the sharks and shysters that you have the misfortune to be stuck with at the moment... and when you give them the keys back enjoy the satisfaction of telling them why you have taken your business elsewhere.

Absolutely, definitely have nothing more to do with these people.

If you have any friends who rent, ask them about their landlords & try them. Look in the phone book &, if possible, ask around about agents you find there. Check out newspaper ads. The key is, talk to friends & relatives if at all possible; if not, try to talk to another tenant in the same building.

If you start feeling like something is wrong, don't waste any more time, just find somebody else. You have spent far too much time with these people; learn a lesson & move on.

It is a breach of health and safety... but tolerated because they love Mickey Mouse so much... it's all Disney fault :rofl:

But on the issue dude get the fuck away from these people, I own buildings and trust me what you just wrote is unacceptable behavior from their ends (I actually can't understand why you let them play with your nerves so much) and if they can't appreciate you being a good tenant, let them get what they deserves for the shit they cause. For your self-respect and sanity don't give them your attention and money either... no matter if they have the most beautiful grass in the neighborhood. Imagine... the place was infested with mice, carrying streptococci, e-coli and all kind of other darn bacteria... just imagine the water pipe brakes and with your luck they'll patch it with PVC but only 5 days later. I'd consider moving if you ever can afford it :)

I am as I had prior to them contacting me was making plans on my own to move and still is. Therefore, this matter will be taken care of soon..

Yes, leave. I know that is a huge burden. And it's not fair - they should make your home livable and they should treat you as a valued tenant.

But the fact is, your history and relationship is with the former owner, and these people don't know you are really care about you.

There are also two other red flags.

  • The first is the mold - you can take your chances with the mice, but the mold is guaranteed to make you sick. You see it on the walls or ceiling, but it releases spores into the air and you are breathing it in. And it is difficult to get rid of. Mold can't be washed away. Wherever it is has to be torn out and replaced. Depending on how many surfaces are affected it could take many thousands of dollars to repair. (My apartment had mold from some water damage in two rooms and it cost about $14,000 to fix it - including replacing half a wall in the kitchen.)
  • The second thing, as I think jaketoronto2004 was alluding to, is that these people are in financial trouble. They are desperate to keep you, but won't fix the problems with your apartment. Anyone who is taking care of a building for the long term knows that you have to fix problems like yours as soon as possible - because the longer you delay the more expensive it will be. If they are dragging their feet it's a sign that they are focusing completely on the short term trying to keep their heads above the water.

I suspect you need to get out before they go bankrupt and take some of your money with them. There have been many stories the last couple of years of people being suddenly turned out of their rental units because the landlord had stopped making payments on their mortgage and the bank repossessed the building.

For your health and sanity I think it's time to move.

Thanks so much!!!..I like the way you put this..as I had stated in my initial post though, I had already made plans to move on my own behalf. But you are so correct in your analogy..thanks again..:thumbs up:
