$1.5 million lawsuit says Colorado woman was injured when drag queen thrust the woman's face into her breasts
A Colorado woman says a drag queen’s breasts have caused her permanent pain.
Neldin Molina of Denver is suing the Hamburger Mary’s in Tampa, Florida, along with a drag queen who works there, for $1.5 million (€1.22 million) for injuries she allegedly sustained while there.
The Miami Herald reported that Molina went to the restaurant with family and friends for a birthday celebration on 30 May 2015 (a Saturday), but had no idea that a drag show was going to take place or that she would be pulled into it.
The Hamburger Mary’s chain, with 18 locations in the U.S. and Canada, is well known for its LGBTI-friendly environment and spirited drag shows.
Drag show
The 53-year-old Molina merely wanted to enjoy her fish and chips, the lawsuit states. However, soon after arriving, the drag show started. Although she occasionally turned to watch parts of the show, she was primarily interested in socializing with her friends.
About an hour into the show, the drag queen, Amanda D’Hod (as named in the suit), approached their table, but Molina tried to ignore her.
The lawsuit claims that D’Hod began to touch Molina’s shoulders while her back was turned and then walked in front of her.
The drag performer then allegedly grabbed Molina’s head and ‘wiggled’ her breasts in Molina’s face eight times.
Next, D’Hod allegedly began ‘violently’ pounding Molina’s face against her breasts ‘up to 9 times.’
Pain and headache
Molina began feeling ‘excruciating pain’ and a headache immediately after the incident. Three days later, she went to a Tampa emergency room with ‘excruciating cervical pain and uncontrollable headaches.’
The suit says Molina now suffers chronic cervical pain and headaches. She takes ‘numerous medications’ and gets regular injections to control the pain.
Before she left the restaurant, the lawsuit says Molina informed the manager that she was in pain. Several weeks after the hospital visit, the manager referred her to their insurance carrier, Tristar Risk Management.
After several months, Tristar informed her the restaurant’s general liability policy did not cover the injuries she sustained.
Seeking $1.5 million
The suit asks for $1.5 million (€1.22 million) for past and future medical expenses as well as pain and suffering, both physical and mental.
Molina’s lawsuit says when the restaurant hostess seated them, she failed to inform them a drag show would be starting shortly. It also says Hamburger Mary’s did not have signs posted regarding the upcoming show or warning of potential health risks.
The suit also says that D’Hod had a lack of concern about whether Molina had any ‘prior medical history or prior neck and back injuries before deciding to take such violent action.’
Although ‘Amanda D’Hod’ is named as the accused drag queen, the lawsuit states it is unsure of the exact name.
A Gay Star News investigation revealed the Tampa Hamburger Mary’s social media refers to one of its regular performing queens as ‘Amanda D’Rod.’ There is also evidence of an ‘Amanda D’Rhod’ who has performed at the hamburger chain in Tampa and was named Miss Heart of Florida 2014.
It is not clear if these are all the same person and the same queen named in the lawsuit.
Gay Star News has contacted Hamburger Mary’s and ‘Amanda D’Rhod’ for comment, but has not yet heard back from them.
